(b) On September15, 2017, Emergent Capital,Inc. (the “Company”) entered into a Mediation Agreement with Antony Mitchell, the Company’s Chief Executive Officer and a member of its Board of Directors (the “Board”), to which Mr.Mitchell agreed, among other things, to negotiate and enter into a separation agreement providing for his resignation from the position of Chief Executive Officer and from the Board, in each case of the Company and its subsidiaries, no later than September22, 2017.

The foregoing description of the Mediation Agreement is qualified in its entirety by reference to such agreement, which is filed as Exhibit 10.1 attached hereto.
